Frequently Asked Questions
Here are answers to questions that you may have regarding the Performance Solution process and the services we offer.
A Performance Solution is an alternative pathway under the National Construction Code (NCC) that demonstrates a building element or system meets the Performance Requirements, even if it doesn’t comply with the Deemed-to-Satisfy (DTS) provisions.
It allows for innovation, flexibility, and practicality by assessing performance through evidence, expert judgement, modelling, or comparison to DTS.
Performance Solutions Australia specialises in developing Performance Solutions for residential and commercial projects across Australia.
Our services include:
- Moisture management and weatherproofing assessments
-
Fire seperation and Fire Engineering Reports
- Energy efficiency and condensation control solutions
- Structural and durability assessments
- Charged stormwater systems
- Accessibility solutions
- Termite and pest alternative solutions
These are only a few of the wide range of services we cater for. Reach out to our team to see if we can help out.
A Performance-Based Design Brief (PBDB) defines the scope, objectives, stakeholders, and relevant Performance Requirements before assessment begins. It sets the framework for how the Performance Solution will be evaluated.
A Performance-Based Design Report (PBDR) is the final documented assessment showing how the design meets NCC Performance Requirements through evidence, analysis, and reasoning.
In simple terms — the Brief is the plan, and the Report is the proof.
For most residential or small commercial projects, PSA typically completes a Performance Solution within 5–10 business days from receipt of all required information (drawings, specifications, and site data).
Complex or multi-discipline projects may require additional time for coordination with structural, hydraulic, or fire engineers.
Yes. PSA frequently prepares retrospective Performance Solutions for existing or completed buildings where a certifier or Building Surveyor requires evidence of compliance.
These assessments may rely on site inspection data, software modelling, and technical documentation from a manufacturer to demonstrate that the built outcome achieves the NCC Performance Requirements without destructive investigation or retrofit wherever possible.
Not exactly. Performance Solutions are alternative compliance pathways, not exemptions. They replace only the specific DTS clauses they address, while the rest of the design must still comply with applicable DTS or other Performance Requirements.
Each solution must independently satisfy the intent and objectives of the NCC provisions it substitutes.
Performance Solutions are prepared by qualified and experienced professionals such as building surveyors, engineers, or specialist consultants like PSA.
However, final acceptance and authorisation lies with the relevant Building Surveyor or Certifier, who reviews the evidence and determines whether the Performance Requirement is satisfied.
Performance Solutions can only address Performance Requirements within the NCC.
They can cover elements such as waterproofing systems, energy efficiency strategies, structural components, or fire separation — provided evidence supports equivalence or superior performance.
They cannot override:
- Planning or zoning controls
-
Building classification or siting requirements
- Workmanship or contractual disputes
In short: Performance Solutions apply only to technical performance compliance, not administrative or planning issues.
Performance Solutions are the formal mechanism for introducing new products, materials, and systems that fall outside traditional DTS provisions.
For example, 3D printed concrete walls, composite waterproof membranes, or modular façade panels can be assessed through testing, modelling, and performance comparison to show they meet NCC objectives.
This approach supports innovation while maintaining safety, durability, and regulatory compliance.
Yes — PSA can consolidate multiple compliance matters (e.g. threshold waterproofing, patio falls, and subfloor ventilation) within a single Performance Solution Report.
However, each Performance Requirement must still be individually addressed and justified within the documentation.
Once PSA finalises the Performance Based Design Report, it is submitted to the Building Surveyor or Certifier for review.
If accepted, the solution becomes part of the approved building documentation.
Any conditions (inspection requirements, maintenance schedules, or product limitations) must be followed to maintain compliance.
Every PSA report follows a structured NCC-aligned format:
- Defined scope and objectives
- Clear Performance Requirements (e.g. H2P1, H2P2, etc.)
- Method of evaluation and risk assessment
- Comparison to Deemed-to-Satisfy
- Acceptance criteria and maintenance schedule
Reports undergo peer review within PSA to ensure regulatory and technical consistency across all projects.
By resolving non-compliances proactively, a Performance Solution allows the certifier to approve innovative or non-standard designs without unnecessary redesign or demolition.
This not only saves time and cost but also provides a clear, documented compliance pathway that withstands audit or regulatory review.
The ideal time to engage PSA is as early as possible in the design or documentation phase — ideally before building permit submission.
Early involvement allows potential non-compliances or design risks to be identified and resolved efficiently through a Performance-Based Design Brief, avoiding costly redesigns or permit delays.
For existing or completed projects, PSA can still assist retrospectively, but early engagement always results in faster approvals, reduced documentation risk, and better integration of Performance Solutions into the overall design intent.
